These Terms of Service ("Terms") govern your use of kiwii.dev and the website design, development, and maintenance services provided by Kiwii Software ("Kiwii," "we," "us"). By engaging our services or using this site, you agree to these Terms.

Our Services

Kiwii designs, builds, and maintains websites for contractors and small businesses. The specific scope, deliverables, and price of any project are agreed in writing before work begins. Pricing shown on this site (starting at $1,500) is indicative; final pricing depends on project scope.

Payment

• Build fees and any monthly maintenance fees are set out in your project agreement.
• Monthly plans are billed in advance and continue until cancelled.
• Late or failed payments may result in suspension of services, including hosting and maintenance.

Revisions & Guarantee

We offer unlimited revisions during the build to get your site right, within the agreed project scope. Requests that materially expand scope may be quoted separately. Any satisfaction guarantee offered (for example, a 30-day money-back period) applies as described in your project agreement.

Client Responsibilities

You agree to provide accurate information and any content (text, images, logos) needed for your project, and you confirm you have the rights to use that content. You are responsible for the accuracy and legality of the information displayed on your website.

Intellectual Property

Upon full payment, you own the final website design and custom content we create for you. Kiwii retains the right to reuse general techniques, code components, and know-how, and to display the completed work in our portfolio unless you request otherwise in writing. Third-party assets (fonts, stock images, plugins) remain subject to their own licenses.

Third-Party Services

Websites we build may integrate third-party tools (CRMs, analytics, booking, hosting). We are not responsible for the availability, performance, or policies of those third-party services.

Disclaimers & Limitation of Liability

We build every site with sound SEO and performance practices, but we do not guarantee specific search rankings, traffic, or business results, which depend on factors outside our control. To the fullest extent permitted by law, Kiwii's total liability for any claim relating to our services is limited to the amount you paid us for the services giving rise to the claim.

Termination

Either party may end an ongoing engagement with written notice as set out in your agreement. Fees for work completed up to termination remain payable.

Changes to These Terms

We may update these Terms from time to time. Continued use of our site or services after changes take effect constitutes acceptance of the revised Terms.
